Agreement

These Terms of Service (“Terms”) govern your access to and use of Familendar (the “Service”), provided by Sifter Studios (“we”, “us”, “our”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The service

Familendar offers shared family calendar features and related tools such as lists, tasks, and trackers, available on the web and through our applications. We may modify, suspend, or discontinue features or the Service as a whole where reasonably necessary (for example for security, legal compliance, or product improvement). We will aim to give reasonable notice of material adverse changes where practicable.

Accounts and eligibility

You are responsible for the accuracy of information you provide and for maintaining the security of your account credentials. You must be legally able to enter a binding contract in your jurisdiction, or use the Service under the supervision of a parent or legal guardian who accepts these Terms on your behalf. You may not share account credentials in a way that circumvents access controls or enables abuse.

Acceptable use

You agree not to misuse the Service. For example, you must not: (a) use the Service for unlawful purposes; (b) attempt to gain unauthorized access to our systems, other users’ data, or third-party services; (c) interfere with or disrupt the Service or its infrastructure; (d) reverse engineer or scrape the Service except as permitted by applicable law; or (e) upload malicious code. You are responsible for content you and your invited family members add to the Service (such as events and list items) as far as applicable law requires.

Subscriptions and payment

Paid plans may be available through checkout hosted by our payment processor (such as Stripe). Fees, billing cycles, taxes, and cancellation rights are shown at purchase and in communications from the processor. This site may display pricing information sourced from our billing configuration; the binding terms for payment are those presented at checkout. If you dispute a charge, contact us through the support options at familendar.com in the first instance.

Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Sifter Studios or our licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable licence to use the Service in line with these Terms. You retain any rights you have in content you submit; you grant us and our subprocessors a licence to host, process, back up, and display that content only as needed to provide the Service to you and people you invite.

Disclaimers and limitation of liability

To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, except those that cannot legally be excluded. We do not warrant that the Service will be uninterrupted or error-free.

To the extent permitted by law, our total aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the claim arose, or (b) one hundred Norwegian kroner (NOK 100), except where mandatory law (including mandatory consumer law) provides otherwise. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or other liability that cannot be limited under applicable law.

Suspension and termination

We may suspend or terminate access to the Service if you materially breach these Terms, if we are required to do so by law, or to protect the Service or other users. You may stop using the Service at any time and may request deletion of your account subject to our Privacy policy and retention obligations. Provisions that by their nature should survive (including intellectual property, disclaimers, and limitations) will survive termination.

Changes to these Terms

We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Where required by law, we will notify you or seek consent. Continued use of the Service after changes take effect may constitute acceptance of the revised Terms where permitted by law.

Contact and governing law

Sifter Studios operates Familendar from Norway. For questions about these Terms, contact us via the Support link at familendar.com. These Terms are governed by the laws of Norway, without regard to conflict-of-law rules. If you are a consumer resident in the European Economic Area or the United Kingdom, you may also benefit from mandatory protections of the laws of your country of residence, and you may have the right to bring proceedings in your local courts.
